This section is bailable. Who knows, all the individuals who indulged in riots will get bail too! IPC 146 says whenever force or violence used by an unlawful assembly, or by any member thereof, in prosecution of the common object of such assembly, every member of such assembly is guilty of offence of rioting. This section is bail able. IPC 147 says about the punishment for rioting – whoever is guilty of rioting, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or both. IPC 149 says that every member of unlawful assembly guilty of offence committed in prosecution of common object. The offence is cognizable or non-cognizable and bail able or non-bail able depending upon the offence. Here lies the loophole.
Now, just like Raj Thackeray, all the individuals who abetted and indulged in riots may get bails. If Raj Thackeray got the bail, all his followers too may get the same due to ‘political obligations’. Then, where is the rule of law? If getting bail is easier, even if violated laws by those who are in public life, how can one find upholding the rule of law? Mumbai police must disclose the content of FIR and Charge sheet to the press and prosecute the guilty impartially to uphold the rule of law of the land, as a roll model to the remaining country.
