EC files counter in Allagadda poll case HYDERABAD: The Election Commission of India told the Hyderabad High Court that deleting the name of a deceased candidate of an unrecognised political party from the list of contesting candidates could encourage attempts at eliminating such candidates in order to win or alter the result of an election.
Section 52 of the Representation of People's Act, 1951, does not provide for deferring the election or substitution of a candidate of an unrecognised party after publication of the list of contesting candidates, it noted.
In this regard, the ECI has filed its counter- affidavit before a division bench dealing with writ petitions with a plea to print a fresh ballot paper after deleting the name of deceased candidate B Shobha Nagi Reddy in the election for Allagadda Assembly segment held on May 7 this year.
The bench directed the petitioners to file reply to the counter-affidavit of the ECI and adjourned the case hearing by 10 days.
