WB appointed panel to take over city's famous Madarsa Hyderabad, May 6 (INN): With the conviction of four persons on the charges of forgery and fraudulent activities to own 46-acres of prime land belonging to Darul ul Uloom Sabeel us Salaam (DUSS), the Wakf Board appointed panel is expecting to take over the famous Islamic seminary.
Addressing a press conference here on Wednesday, Azaz-ur-Rahman, the Mutawalli, informed that the VI Additional Chief Metropolitan Magistrate P Bhaskara Rao, has sentenced four people associated with the DUSS to three years rigorous imprisonment and other penalization.
The four accused Syed Ismail Ali, Mohammed Fareeduddin, Syed Waheeduddin and Mohd Hassan UI Quasmi were involved in a series of fraudulent activities and are close relatives of late Moulana Rizwan ul Qasmi.
According to Azaz ur Rahman, the DUSS was founded by (late) Syed Zia ur Rahman who appointed Rizwan ul Quasmi as a teacher, and inducted him as a committee member in the year 1976. As the founder, Zia kept the 46 acres of land for running the 'Madarsa' wherein a graveyard for Muslims, school buildings, mosque, staff quarters and students hostel were constructed.
After the death of the founder Syed Zia Ur Rahman in 1992, Rizwan UI Quasmi was appointed as the President of the Committee of which Azaz ur Rahman, son of the founder Syed Zia ur Rahman was also designated a member. After the death of Rizwan UI Quasmi on October 11, 2004, when the family members started claiming the Madarsa land as their own and buried him in the middle of the land instead of assigned graveyard, Syed Azaz Ur Rahman approached the MRO to check the reality behind their claim.
Startling facts have surfaced wherein the Patta was converted from Madarsa name to his own name. This process of converting the land into his name commenced from the eighth day of the death of the founder. Then Azaz ur Rahman filed a case before the RDO to cancel the same. Further, he applied to Wakf Board for registering entire Madarsa property as a Wakf property to protect the same from any encroachment or misappropriation. His action was ratified by the existing committee members and relatives of Rizwan UI Quasmi. Accordingly, Wakf Board registered the same as Wakf property on Decemer 29, 2004 by appointing Azaz as Mutawalli and later approved 11 member Towliath Committee.
Azaz came to know through a writ petition that the DUSS is a registered society. Surprisingly, the society was formed by forging signatures of dead persons 1) Syed Zia Ur Rahman, President, DUSS, who died in 1992, 2) Mohd. Ali, Vice President, died in 1993, 3) Mohd. Imtiaz Ali Hussaini, Secretary, who died in 1984, 4) Khaja Naseeruddin, member who died in 1989 and 5) Hameed Ali Hasan, Treasurer, who died in 1995. The accused also submitted that the aforementioned (dead) persons have convened meetings in the said society at Murad Nagar, Mehdipatnam on 23-9-2000 and on 23-10-2000 and constituted new committee members to persons submitted resignation letters, though they died long time ago to the alleged meetings, for resignation letters as if they resigned.
In its judgment, the court said, "The material on record discloses that accused committed serious offences by forging signatures of dead persons and fabricated the record to knock away the property dedicated for the charitable purpose, hence, they do not deserve leniency and shall be punished properly or else it leads to miscarriage of justice."
In view of this conviction, Azaz ur Rahman said the existing seminary and its students would continue to function as routine and further evolve to better standards of functioning and education with the help of Towliath Committee, already approved by Wakf Board. He also said that the seminary would be developed into an excellent hub for all-round development and empowerment of its students.
Other committee members Mohammed Jaffar, Mohammed Qader Pasha and Mufti Nisar Ahmed were also present in the press conference.
